Employee goes to bed after their shift got cancelled, only to wake up and find out it was rescheduled without them knowing: ‘Now I must report to HR regarding my No Call No Show’

  • Shift canceled so i went back to bed, they rescheduled me while sleeping without me knowing.

    This is utter b ive just got written up over the scheduling department changing their mind and HR scheduling a meeting when i couldnt get there even if i knew it was happening.
  • Yesterday scheduling texted me at 1:41pm and said "Tonight you get extra day off, can you work morning or afternoon tomorrow?" When i woke up at 2:30pm, i saw that, decided id respond later, turned my alarms off and went back to sleep until around 11:45pm.
  • Well they had text me back at 4:06pm telling me that they had reversed the cancelation and i was expected to show up, and another text at 10pm telling me they were considering me as a No Call No Show, but, i didnt see any of this
  • until id woken up again at which point i couldnt come in even if i wanted to as bus service ends early on Sunday night, and the last bus had already left.
  • I text them back telling them i was just seeing their message, telling them its too late and that i will not be coming in, they didnt seem to understand and kept trying to pressure me to take an uber and show up, but sorry i dont have $70 to drop on an uber that wasnt budgeted for.
  • Well, went back to bed around 7am as normal, phone went back on DND so if they spam me again i wouldnt be disturbed, and woke up at 2:30pm again, well, theyd texted me at 9am telling me i must report to HR at 3pm for a meeting regarding my No Call No Show last
  • night, to which i reminded them yet again of my sleeping hours, since them messaging me something that requires a response while sleeping is common, and informed them i can not be there for 3pm as there are no busses and theyve given me too little notice.

  • Well that was an unacceptable answer in their opinion, so they cancelled my shift again today, in what i assume to be retaliation and told me to come tomorrow for
  • 3pm to meet with HR, which i also told them No but countered with a 5:30pm meeting as busses do not start running until 5pm and i can not get within a reasonable walking distance, to which they said no and told me i have to be there for 3.
  • So we shall see how this goes, ive already filled in our union rep on whats going on and hes also k `d, so hopefully they will go to bat with me, and ive contacted an employment lawyer, again.

  • Formal Evidence_4094 Your mistake was not acknowledging that your first shift was cancelled. If you replied to that one, and then went to bed, they cannot say that they expect you to show up (as they told you not to work and you
  • not to work and you acknowledged on "paper"). Now, because there is no confirmation, the default state is that you were scheduled and had to work.
  • entirecontinetofasia the last minute change is nonsense. however you got woken up at 2:30 pm, meaning you'd already been sleeping, and kept sleeping until 11:45pm? and then went back to bed at 7am and slept until 2:30pm again? so that means in 24 hour period you slept 16.5 hours? that is a lot.
  • ProfanityInspector OP Indeed, but very very much needed, somehow getting a full nights rest does not make me feel rested, plus getting to bed a bit late waiting on my laundry did not help.
  • entirecontinetofasia exhaustion? i sympathize. the employer may expect you to have more availability though. good luck with your meeting! if you think a medical issue is going on that can help your case
  • ProfanityInspector OP Maybe so, but if they do expect more availability and flexibility, they need to communicate that. Typically i work the same shift and the same days every week, they have never tried to change my offical schedule outside of the odd overtime shift to fill an absence, which i usually take, thats how its been since i started here.
  • But something i will definitely bring up when i meet with HR now that you mention it.
